By accessing or using CardPicker ("the Service"), operated by The Button Factory, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. We reserve the right to update these Terms at any time; continued use of the Service constitutes acceptance of any changes.

2. Description of Service

CardPicker is a free web-based tool that analyzes your spending patterns — via bank connection (Plaid) or CSV upload — and generates personalized credit card recommendations based on potential rewards earnings. The Service is provided free of charge and is intended for personal, informational use only.

3. Not Financial Advice

CardPicker does not provide financial, investment, tax, or legal advice. The recommendations generated by CardPicker are estimates based on:

• Your historical transaction data as provided
• Our best-effort representation of current card reward structures
• Simplified reward calculation models that may not capture all card benefits, caps, or terms

Actual rewards earned will depend on your individual circumstances, card approval, spending habits, promotional offers, and changes to card terms. Always review a credit card's full terms and conditions, including interest rates and fees, before applying. Consult a qualified financial advisor for personalized financial guidance.

4. Eligibility

You must be at least 18 years of age to use CardPicker. By using the Service, you represent that you are 18 or older and have the legal capacity to enter into these Terms.

5. User Responsibilities

By using CardPicker, you agree to:

• Provide accurate data and not upload fraudulent, synthetic, or third-party transaction data without authorization
• Use the Service for lawful purposes only
• Not attempt to reverse-engineer, scrape, or abuse the Service
• Not use the Service to infringe on the intellectual property or privacy rights of others
• Comply with Plaid's End User Privacy Policy if you use the bank connection feature

6. Plaid as a Third-Party Service

The bank connection feature is powered by Plaid Inc. ("Plaid"), a third-party financial data aggregator. Your use of Plaid's services is governed by Plaid's own Terms of Use and Privacy Policy. The Button Factory is not responsible for Plaid's services, data practices, or any issues arising from your use of Plaid. You may disconnect CardPicker's access to your bank accounts at any time via my.plaid.com.

7. Intellectual Property

The CardPicker Service, including its software, design, and content, is owned by The Button Factory. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. You may not reproduce, distribute, or create derivative works from any part of the Service without our express written permission.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT THE REWARD CALCULATIONS WILL BE ACCURATE OR COMPLETE. CREDIT CARD TERMS CHANGE FREQUENTLY AND OUR DATABASE MAY NOT REFLECT THE MOST CURRENT REWARD STRUCTURES.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE BUTTON FACTORY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM: (i) YOUR USE OF OR INABILITY TO USE THE SERVICE; (ii) ANY CREDIT CARD DECISIONS MADE BASED ON THE SERVICE'S RECOMMENDATIONS; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA; OR (iv) ANY OTHER MATTER RELATING TO THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED $100 USD.

10. Indemnification

You agree to indemnify and hold harmless The Button Factory and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in New York County, New York, and you consent to the exclusive jurisdiction of those courts.

12. Termination

We reserve the right to suspend or terminate access to the Service at any time, for any reason, without notice. Given the stateless nature of the Service, no data will be retained after your session expires.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms shall continue in full force and effect.
